Welcome to Loudness.ai! These Terms and Conditions (the “Terms”) are a legal agreement between you and loudness.ai (“Loudness.ai,” “we,” “us,” or “our”). They govern your use of the Loudness.ai website, the music editing services, and any related applications (collectively, the “Service”).

1. Using Loudness.ai

You are responsible for keeping your account login details secure and for all activities that happen under your account. You must notify us immediately if you suspect any unauthorized use of your account.

You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all local, state, national, and international laws, rules, and regulations.
2. Your Content and Ownership
A. Ownership of Your Content
When you upload audio files, music, and other content to the Service (your “Content”), you retain all ownership rights in that Content. Loudness.ai does not claim any ownership over your music or audio files.
B. License to Loudness.ai
You grant Loudness.ai a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Content only as necessary to provide, maintain, and improve the Service. For example, we need this license to process your audio file when you click “Master” or “Edit.”
C. Responsibility for Content
You are solely responsible for your Content. You represent and warrant that you own or have the necessary rights to use and authorize the use of your Content as described in these Terms, and that your Content does not violate any third-party rights (like copyright).
3. Acceptable Use Policy (What You Cannot Do)
You agree not to use the Service to:
- Infringe on Rights: Upload or process any content that infringes on the copyrights, trademarks, or other intellectual property rights of others.
- Harm/Abuse: Upload or transmit any content that is illegal, abusive, harassing, defamatory, or harmful.
- Spam/Malware: Transmit viruses, worms, or any code of a destructive nature.

The Service, including the visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, and all other elements of the Service (excluding your Content), are owned by Loudness.ai and are protected by copyright, trademark, and other laws. You may not modify, reproduce, or distribute any part of the Service without our written permission.
6. Disclaimers and Limitation of Liability
A. “As Is”
The Service is provided on an “as is” and “as available” basis. Loudness.ai makes no warranties, express or implied, regarding the Service, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
B. Limitation of Liability
To the maximum extent permitted by law, Loudness.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising from the Service will not exceed the amount you paid to us in the 12 months preceding the claim.
